Summary Proceedings and Ex Parte Orders
Explanation
This explanation provides an educational and simplified clarification of procedural concepts, and is not a substitute for the explicit legal texts presented separately. The single judge (le juge unique), acting as the judge of urgent matters (juge des référés), undertakes urgent measures in civil and commercial matters without prejudicing the merits of the right (le fond du droit), while observing the special jurisdiction established for the head of the enforcement department. The judge, in the same capacity, has jurisdiction to take measures aimed at removing a clear infringement on legitimate rights or situations, and may also grant the creditor a provisional advance (une provision) on account of their right if the debt is not subject to serious dispute.
Territorial jurisdiction (la compétence territoriale) in summary justice belongs either to the single judge who has jurisdiction over the merits of the dispute or the jurisdiction of the court of first instance or any other court within its district, or to the single judge in whose district the subject matter of the urgent lawsuit arose. On the other hand, the law restricts the possibility of urgent intervention in appealed disputes. No measure relating to a case presented before the court of appeal (la cour d'appel) may be requested unless two concurrent conditions are met: the judgment of first instance must be issued in favor of the party requesting the measure, and the requested measure must not conflict with this judgment.
The procedures of the urgent lawsuit are characterized by extreme speed to confront imminent danger, as hearings are held at a date and time determined by the judge. The original time limit for appearance is one full day, with the judge empowered to shorten it. The legislator also permitted the judge, when necessary, to authorize summoning the litigants to appear before them in court, at the site of the dispute, or even at their private residence, at any time including official holidays and outside official working hours. In such cases, a bailiff (un huissier) is delegated to notify the summons and the decision to shorten the time limit.
Alongside the general urgent jurisdiction, the judge of the merits (le juge du fond) and the judge of urgent matters (subject to appeal restrictions) share the authority to take all provisional and conservatory measures (mesures provisoires et conservatoires) to preserve rights and prevent harm, upon the request of one of the litigants and with or without a guarantee (cautionnement). The law provides examples of these measures, including the affixing of seals (l'apposition des scellés), inventory of assets (l'inventaire), imposition of judicial receivership (le séquestre judiciaire), sale of perishable goods, and statement of condition (le constat d'état).
Orders on petitions are subject to the system of non-contentious jurisdiction (la matière gracieuse), where the non-contentious request (la demande gracieuse) is submitted by a petition to the judge or court with jurisdiction, and is examined in the council chamber (la chambre du conseil). In these procedures, the judge conducts the investigation on their own motion and in a non-public manner. They possess the authority to conduct all investigations they deem useful and to hear the testimony of any person they believe could enlighten the court or whose interests might be affected by the intended decision.

The judge conducts the investigation on their own motion in a non-public manner and carries out all useful investigations, and may hear any person who can enlighten them or whose interests may be affected by the decision (Article 596).
Case problems
A merchant imported a large quantity of highly perishable vegetables, which arrived at a warehouse located within the jurisdiction of the single judge in Metn. An immediate dispute arose between the importer and the carrier, who withheld the goods and refused to deliver them. Given the onset of the goods' spoilage and the fact that the day of the dispute fell on a Sunday (an official holiday), the importer immediately went to the residence of the single judge in Metn, petitioning for intervention to save the value of the goods. The judge decided to shorten the time limit for appearance, summoned the carrier to appear immediately at the judge's residence to conduct the trial, and issued a decision to sell the perishable vegetables and appoint an expert for a statement of condition, without imposing a guarantee. The carrier objected, arguing the invalidity of the procedures due to holding the hearing on a holiday and at the judge's residence, and that selling the goods prejudiced the merits of the contractual dispute.
Model answer
Regarding territorial jurisdiction, the single judge in Metn has territorial jurisdiction to hear the urgent lawsuit, because the subject matter of the urgent lawsuit (the goods located in the warehouse) arose in their district (Article 580).
Regarding the time and place of holding the hearing and shortening the time limit, the law explicitly stipulates that the judge may decide to shorten the time limit for the summons, which is set at one full day, and may authorize summoning the litigants within the time limit they designate either to the court, to the site of the dispute, or to their residence, even on official holidays and outside legal working hours. Therefore, summoning the carrier to the judge's residence on a Sunday after shortening the time limit and delegating a bailiff for notification fully complies with the text of the law, and its procedures are valid (Article 582).
Regarding the measure of selling the goods and the statement of condition, the judge of urgent matters may take all provisional and conservatory measures that would preserve rights and prevent harm, explicitly including the sale of perishable goods and the statement of condition, and it is also permitted to take them with or without a guarantee (Article 589).
Regarding not prejudicing the merits of the right, the measure of sale dictates preserving the financial value of the goods exposed to certain spoilage without the judge ruling on the entitlement of either party to collect the price or on the validity of the clauses of the transport contract, which keeps the merits of the dispute preserved without prejudice according to the requirements of the law (Article 579).
Self-grading rubric
The owner of a building filed a lawsuit against the tenant of a commercial warehouse, and a judgment of first instance was issued by the court of first instance ordering the tenant to vacate the warehouse and hand it over to the owner. The tenant proceeded to appeal the judgment before the court of appeal. During the appeal phase, the tenant filed a lawsuit before the judge of urgent matters requesting to prevent the owner from interfering with them and to enable them to remain in the warehouse to prevent the disruption of their trade. At the same time, the owner filed a counter-lawsuit before the judge of urgent matters requesting the imposition of judicial receivership and the temporary affixing of seals on the warehouse due to the receipt of information indicating the tenant's intention to smuggle its contents and sabotage the equipment. The tenant argued that the judge of urgent matters lacked the authority to intervene because the entire dispute file was with the court of appeal.
Model answer
Legal rules govern the conditions for the intervention of the judge of urgent matters in any case presented before the court of appeal, as they explicitly require that the judgment of first instance be issued in favor of the party requesting the measure, and that the requested measure must not conflict with this judgment of first instance (Article 581).
Regarding the tenant's request: The judgment of first instance ordered the eviction against them, and therefore the judgment was not issued in their favor. Moreover, their request to be enabled to remain completely conflicts with the judgment of first instance issued for eviction, and therefore the judge of urgent matters must reject the tenant's request for its explicit violation of the law (Article 581).
Regarding the owner's request: The judgment of first instance was issued in their favor (ordered the eviction of the tenant). The measure of affixing seals and imposing judicial receivership aims to prevent harm and preserve the warehouse and its equipment, which is a measure that does not conflict with the judgment ordering the eviction in their favor, but rather proceeds in the same direction of the protection established for them.
The judge of urgent matters is entitled to hear and approve the owner's request, since the imposition of judicial receivership and the affixing of seals are among the provisional and conservatory measures permissible to be taken to preserve rights and prevent harm, and the judge has the authority to impose them with or without a guarantee without prejudicing the merits of the right (Articles 581 and 589).
